Daniel Holtzclaw's Appeal Denied

OKC, OK - Daniel Holtzclaw's attorneys filed an appeal in his case in early 2017. Holtzclaw's defense claimed that the prosecution had insufficient evidence to prove Holtzclaw "used or threatened to use force or violence against any of the victims."

The appeal proposed that a fundamental error occurred when the state was allowed to prosecute thirty six alleged crimes against thirteen separate women in one trial, encouraging the jury to convict based on aggregate of the evidence rather than adequate proof of each individual charge.

The attorneys claimed there was a "circus atmosphere" that pervaded throughout the trial which deprived Holtzclaw of a fair trial. The appeal also claimed the sentence was an 'unconstitutionally excessive sentence,' and asked that they be modified to run concurrently.

An Oklahoma court on Thursday, August 1 ruled to deny the appeal from the former Oklahoma City police officer convicted of rape and other sexual assaults.

Holtzclaw, an Enid native, was sentenced in 2015 to life in prison — 263 years — for 18 counts of sexual assault (he was charged with 36 counts). His case brought journalist Michelle Malkin to Enid in December 2016.

After an in depth investigation, involving trial transcripts, photographs and video of the crime scenes, discovery documents and personal interviews with OKC detectives and community members, Malkin concluded that there was a very real possibility that Holtzclaw could be entirely innocent of the charges.

Malkin set out to uncover the hidden scandals and corruption the liberal and corporate media refused to cover in the case. Her online TV show, Michelle Malkin Investigates, featured two episodes in which she presented her case. She brought the shows plus a Q&A to Enid to give local residents a chance to see the evidence and ask questions.
